Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SightRadar — Face Recognition API and the sightradar.com website and developer console (collectively, the "Service") operated by SightRadar ("we", "us", "our"). By creating an account, generating an API key, or otherwise using the Service, you agree to these Terms.
1. The Service
SightRadar is a developer API for face recognition. It lets you detect faces in images, index face embeddings into collections, search for matching faces, and compare two faces. The Service is billed on a pay-as-you-go credits (no subscription, no auto-renewal) basis — you purchase credits in advance and API calls draw down your balance.
The Service is intended for software developers and businesses integrating face recognition into their own applications. It is not a consumer product.
2. Accounts and API keys
You must register an account with a valid email address to use the Service. You are responsible for safeguarding your API keys and for all activity that occurs under your account. Treat API keys as secrets — do not embed them in client-side code or public repositories. You may rotate or revoke keys at any time from the console.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
3. Acceptable use and your responsibilities
Face recognition is a sensitive technology. You are solely responsible for ensuring that your use of the Service complies with all applicable laws, including data-protection, privacy, biometric, and consent laws in the jurisdictions where you and your end users operate.
You agree that you will not, and will not permit your end users to, use the Service to:
- Process images of any individual without a lawful basis and, where required, their informed consent;
- Conduct unlawful surveillance, stalking, or tracking of individuals;
- Identify or profile individuals on the basis of race, ethnicity, religion, or other protected characteristics in a discriminatory manner;
- Process biometric data of children except where you have verifiable lawful authority to do so;
- Violate the intellectual-property, privacy, or other rights of any third party;
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its infrastructure;
- Resell or sublicense the raw Service as a competing face-recognition API without our written agreement.

You are the controller of the personal data you submit. We process it on your behalf as described in our Privacy Policy and Data Processing Addendum.
4. Prohibited activities
In addition to the acceptable-use rules above, you agree not to, and not to permit anyone acting through your account or API keys to:
- Access the Service through automated means in a way designed to evade rate limits, metering, or billing;
- Circumvent, disable, or interfere with security-related features of the Service;
- Probe, scan, or test the vulnerability of the Service or breach its authentication or access controls without our prior written consent;
- Submit malware, or content that infringes, defames, or violates the rights of others;
- Misrepresent your identity or affiliation, or impersonate any person or entity;
- Use the Service to build a competing face-recognition API, or to benchmark it for a competitor, without our written agreement;
- Use the Service in any manner that violates applicable export controls, sanctions, or the laws of any jurisdiction where you operate.
A breach of this section is a material breach of these Terms and may result in immediate suspension or termination under Section 9.
5. Your representations
By using the Service, you represent and warrant that:
- The registration information you provide is true, accurate, current, and complete, and you will keep it updated;
- You have the legal capacity to agree to these Terms and are not a minor in your jurisdiction;
- You will not use the Service for any unlawful or unauthorized purpose;
- You have, and will maintain, a lawful basis and (where required) consent to process every individual whose image you submit;
- Your use of the Service will not violate any applicable law, regulation, or third-party right.
If any information you provide is untrue or incomplete, we may suspend or terminate your account and refuse current or future use of the Service.
6. Intellectual property
The Service, including its software, APIs, documentation, website design, and the SightRadar name and logo (collectively, our “IP”), is owned by SightRadar or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes and to integrate it into your own applications.
We reserve all rights not expressly granted. You may not copy, modify, resell, or create derivative works of our IP except as these Terms permit. Any feedback or suggestions you send us may be used by us without restriction or obligation to you; we will not, however, publicly identify you as a customer without your consent.
7. Data ownership and tenant isolation
You retain all rights to the images and data you submit (“Your Data”). We claim no ownership over it. Each account's face vectors are namespaced and logically isolated — your data is never searchable by, or disclosed to, any other customer.
We process Your Data only to provide the Service to you. We do not use Your Data to train general-purpose models. You can delete your collections and stored faces at any time via the API or console.
8. Credits, billing, and payment
The Service uses pay-as-you-go credits purchased in advance. You purchase credit packs through our Merchant of Record, Dodo Payments, who processes the payment, handles applicable taxes, and issues your receipt. We do not store or process your card details.
API calls debit credits at the rates published on our Pricing page. Control-plane operations (creating, listing, and deleting collections; checking your wallet; health checks) are free and never draw down your balance. Credits do not expire while your account is in good standing. Refunds are governed by our Refund & Cancellation Policy.
9. Service availability and changes
We work to keep the Service available and performant, but we provide it on an “as is” and “as available” basis without uptime guarantees unless agreed in a separate written contract. We may update, improve, or modify the Service and these Terms; material changes will be reflected by the “Last updated” date above and, where appropriate, communicated to you.
10. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, use the Service unlawfully, or create risk or legal exposure for us or other users. On termination, you may export or delete Your Data; we will delete it in the ordinary course thereafter.
11. Disclaimers and limitation of liability
Face recognition is probabilistic. Matches and similarity scores are statistical estimates and may contain false positives or false negatives. You must not rely on the Service as the sole basis for decisions that have legal or significant effects on individuals. To the maximum extent permitted by law, the Service is provided without warranties of any kind, and our aggregate liability arising out of or relating to the Service will not exceed the amount you paid us in the three months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and costs arising out of your use of the Service or your breach of these Terms, including claims that your processing of personal data lacked a lawful basis or required consent.
13. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Disputes will be subject to the courts of competent jurisdiction located there.
